  1                      A bill to be entitled

  2         An act relating to tobacco; requiring retailers

  3         to situate tobacco products, cigars,

  4         cigarettes, and pipes where they are not easily

  5         accessible to minors; providing an effective

  6         date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Limits on minors' access to smoking-related

11  products.--

12         (1)  The owner or manager of a retail establishment in

13  which tobacco products as defined in section 210.25, Florida

14  Statutes, cigarettes as defined in section 210.01, Florida

15  Statutes, or cigars, pipe tobacco, or pipes suitable for

16  smoking are sold shall situate such products behind the

17  counter or in another area of the retail establishment which

18  is inaccessible to customers who are minors.

19         (2)  Any person who violates subsection (1) commits a

20  misdemeanor of the second degree, punishable as provided in

21  section 775.082 or section 775.083, Florida Statutes.

22         Section 2.  This act shall take effect July 1, 1999.
