  1                      A bill to be entitled

  2         An act relating to foreign corporations;

  3         requiring certain foreign corporations to file

  4         copies of their employee benefit plans with the

  5         Department of Labor and Employment Security;

  6         requiring such corporations to provide notice

  7         of such filing to their employees; authorizing

  8         the department to collect fees and adopt rules;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  (1)  Each foreign corporation, as defined

14  in section 607.01401, Florida Statutes, that has a fixed

15  location in this state and that employs more than 200

16  residents of this state must:

17         (a)  File with the Department of Labor and Employment

18  Security a complete copy of its employee benefits plan,

19  including changes or modifications to the plan which occur

20  after the original filing.

21         (b)  Post notice of the filing in at least two places

22  in each fixed location in this state at which it employs

23  residents of this state, which notice must include information

24  on how employees may obtain a copy of the filing from the

25  department.

26         (2)  The Department of Labor and Employment Security

27  may charge each corporation filing a copy of its employee

28  benefits plan a filing fee, to be set by the department by

29  rule. The department may charge each employee who requests a

30  copy of the filed employee benefits plan a fee, to be set by

  1  the department by rule, which fee may not exceed the amount

  2  necessary to defray the cost of copying and mailing the plan.

  3         Section 2.  This act shall take effect January 1, 2000.

  6                          SENATE SUMMARY

  7    Requires each foreign corporation having a fixed location
      in, and employing more than 200 residents of, the state
  8    to file with the Department of Labor and Employment
      Security a copy of its employee benefits plan and give
  9    the employees notice of the filing. Authorizes the
      department to set fees for corporations making filings
10    and for furnishing copies of filings to employees.
