18  and insert in lieu thereof:

19         costs unless the party retaining the expert witness

20  furnishes each opposing party with a written report signed by

21  the expert witness which summarizes the expert witness's

22  opinions and the factual basis of the opinions, including

23  documentary evidence and the authorities relied upon in

24  reaching the opinions. Such report shall be filed at least 5

25  days prior to the deposition of the expert or at least 20 days

26  prior to discovery cut-off, whichever is sooner, or as

27  otherwise determined by the court.
