11  The Committee on Health Care Services offered the following:

13         Amendment (with title amendment) 

14  Remove from the bill:  Everything after the enacting clause

15

16  and insert in lieu thereof:

17         Section 1.  Subsection (5) of section 39.202, Florida

18  Statutes, 1998 Supplement, is amended to read:

19         39.202  Confidentiality of reports and records in cases

20  of child abuse or neglect.--

21         (5)  All records and reports of the child protection

22  team of the Department of Health are confidential and exempt

23  from the provisions of ss. 119.07(1) and 455.667, and shall

24  not be disclosed, except, upon request, to the state attorney,

25  law enforcement, the department, and necessary professionals,

26  in furtherance of the treatment or additional evaluative needs

27  of the child, or by order of the court, or to health plan

28  payors, limited to that information used for insurance

29  reimbursement purposes.

30         Section 2.  This act shall take effect July 1, 1999.

 7         An act relating to child protective team

 8         services; amending s. 39.202, F.S.; authorizing

 9         the sharing of otherwise confidential

10         information with health plan payors for

11         purposes of reimbursement for child protection

12         team services; providing an effective date.
