17  and insert:

18         Section 38.  Sections 205.1951, 585.70, 585.71,

19  585.715, 585.72, 585.73, 585.74, 585.75, 585.76, 585.77,

20  585.78, 585.79, 585.80, 585.81, 585.82, 585.83, 585.84,

21  585.85, 585.86, 585.87, 585.88, 585.90, 585.902, 585.903,

22  585.904, 585.91, 585.93, and 585.96, Florida Statutes, are

23  repealed.

24         Section 39.  Subsection (6) is added to section 823.14,

25  Florida Statutes, to read:

26         823.14  Florida Right to Farm Act.--

27         (6) LIMITATION ON DUPLICATION OF GOVERNMENT

28  REGULATION.--It is the intent of the Legislature to eliminate

29  duplication of regulatory authority over farm operations as

30  expressed in this subsection. Except as otherwise provided for

31  in this section and s. 487.051(2), and notwithstanding any

  1  other provision of law, a local government may not adopt any

  2  ordinance, regulation, rule, or policy to prohibit, restrict,

  3  regulate, or otherwise limit an activity of a bona fide farm

  4  operation on land classified as agricultural land pursuant to

  5  s. 193.461, where such activity is regulated through

  6  implemented best-management practices or interim measures

  7  developed by the Department of Environmental Protection, the

  8  Department of Agriculture and Consumer Services, or water

  9  management districts and adopted under chapter 120 as part of

10  a statewide or regional program. When an activity of a farm

11  operation takes place within a wellfield protection area as

12  defined in any wellfield protection ordinance adopted by a

13  local government, and the adopted best-management practice or

14  interim measure does not specifically address wellfield

15  protection, a local government may regulate that activity

16  pursuant to such ordinance. This subsection does not limit the

17  powers and duties provided for in s. 373.4592 or limit the

18  powers and duties of any local government to address an

19  emergency as provided for in chapter 252.
