  1                      A bill to be entitled

  2         An act relating to computer technology;

  3         providing for governmental products and

  4         services to be made available on the Internet

  5         under certain circumstances; directing the

  6         appropriate state agencies to make certain

  7         products and services available on the Internet

  8         within a described time period; directing the

  9         state system of public education to make

10         reasonable progress towards making certain

11         products available on the Internet; providing

12         for the responsibilities of the Department of

13         Management Services with respect to information

14         technology; providing for state agency

15         information technology plans; providing for

16         audits; providing an effective date.

18  Be It Enacted by the Legislature of the State of Florida:

19

20         Section 1.  Government products and services on the

21  Internet.--

22         (1)  The appropriate state entities shall allow the

23  following services to be transacted on the Internet on or

24  before July 1, 2002:

25         (a)  Application for and renewal of professional and

26  occupational licenses.

27         (b)  Application for hunting and fishing licenses.

28         (c)  Renewal of drivers' licenses.

29         (d)  Filings for sales tax, court documents, and

30  Uniform Commercial Code.

  1         (e)  Registrations for products, brands, motor

  2  vehicles, corporations, and businesses.

  3         (f)  Submission of an application for unemployment,

  4  welfare, and health benefits.

  5         (2)  The state system of public education, in

  6  coordination with the Department of Education, shall make

  7  reasonable progress toward making the following services

  8  available through the Internet by July 1, 2002:

  9         (a)  Secure access by parents and students to student

10  grades and progress reports.

11         (b)  Electronic mail communications with teachers,

12  parent-teacher associations, and school administrators.

13         (c)  Access to school calendars and schedules.

14         (d)  Teaching resources that may include teaching

15  plans, curriculum guides, and media resources.

16         (3)  State entities shall, in carrying out the

17  requirements of this section, take reasonable steps to ensure

18  the security and privacy of records.

19         (4)  A state entity is not required to provide a

20  transaction through the Internet that is impractical,

21  unreasonable, or not permitted by laws pertaining to privacy

22  or security.

23         Section 2.  Department of Management Services;

24  duties.--

25         (1)  The Department of Management Services shall:

26         (a)  Develop specific information technology

27  objectives, policies, procedures, and standards to guide the

28  development of information systems within state government to

29  achieve maximum economy and quality while preserving optimum

30  user flexibility, including:

  1         1.  Policies, standards, and procedures for appropriate

  2  interchange of information, optimum service, and minimum cost.

  3         2.  Policies for costing all information technology

  4  services.

  5         3.  Policies governing coordination, cooperation, joint

  6  efforts, working relationships, and cost accounting relative

  7  to the development and maintenance of information technology

  8  systems.

  9         4.  Policies to ensure the protection of individual

10  privacy and guarantee the exclusive control to a user of its

11  own data.

12         (b)  Coordinate the preparation of agency information

13  technology plans within state government, encompassing both

14  short-term and long-term needs that support the agency's and

15  the state's strategic plans.

16         (c)  Require each state agency to submit semiannually

17  an agency information technology plan containing the

18  information required by subsection (2) before the legislative

19  session in which the budget request will be heard and no later

20  than June 15 after the legislative session in which the budget

21  was authorized.

22         (d)  Upon receipt of a state agency's information

23  technology plan:

24         1.  Review and approve or disapprove agency information

25  technology plans to ensure that these plans are the most

26  economically viable and are the best solution to the agency's

27  needs.

28         2.  Approve or disapprove of and coordinate the

29  acquisition of information technology equipment,

30  telecommunications equipment, and related services for all

31  agencies of state government.

  1         (e)  Facilitate the implementation of agency plans.

  2         (f)  Establish priorities in terms of both importance

  3  and time sequencing for the development and implementation of

  4  information systems.

  5         (g)  Monitor information systems development to promote

  6  maximum use of existing state information resources.

  7         (h)  Advise the Governor on information technology

  8  policy and make recommendations to the Governor regarding

  9  requests for information technology equipment and personnel.

10         (i)  Maintain liaison with the legislative and judicial

11  branches, the Board of Regents, the State Board of Education,

12  local government, Federal Government, business and industry,

13  and consumers to promote cooperation and make recommendations

14  regarding information resources.

15         (j)  Conduct performance audits of state information

16  technology management, planning, and the use of information

17  technology resources and distribute copies of the audit

18  reports as provided in subsection (3).

19         (k)  Prepare an annual report to the Governor and the

20  Legislature that:

21         1.  Summarizes the state's current and projected use of

22  information technology.

23         2.  Includes a description of major changes in state

24  policy and a brief description of each state agency's plan.

25         (l)  As permitted by law, coordinate the efforts of

26  state government to provide services and transactions through

27  the Internet.

28         (2)(a)  Each state agency information technology plan

29  shall include information about planned information technology

30  objectives and expenditures for the next year in the level of

  1  detail and format specified by the Department of Management

  2  Services.

  3         (b)  The plans required by this subsection shall

  4  include the progress of each state agency toward making the

  5  agency's services available on the Internet.

  6         (3)  Upon completion of an audit report, the Department

  7  of Management Services shall provide copies of all audit

  8  reports to:

  9         (a)  The agency audited.

10         (b)  The Governor.

11         (c)  The chairs of the legislative appropriations

12  committees.

13         Section 3.  This act shall take effect July 1, 2000.

20    registrations for products, brands, motor vehicles,
      corporations, and businesses and submission of an
21    application for unemployment, welfare, and health
      benefits through the Internet by July 1, 2002.  Directs
22    the state system of public education to make reasonable
      progress toward making secure access by parents and
23    students to grades and progress reports, electronic mail
      communications with teachers, parent-teacher
24    associations, and school administrators, access to school
      calendars and schedules, and teaching resources available
25    through the Internet.  Provides for the duties of the
      Department of Management Services with respect to
