  1                      A bill to be entitled
  2         An act relating to candidates for public
  3         office; amending s. 99.012, F.S.; eliminating
  4         the requirement that a subordinate officer,
  5         deputy sheriff, or police officer who is
  6         seeking public office and who is not required
  7         to resign to run for that office must, upon
  8         qualifying, take a leave of absence without pay
  9         during the period of that candidacy; providing
10         an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

14         Section 1.  Subsection (5) of section 99.012, Florida
15  Statutes, is amended to read:
16         99.012  Restrictions on individuals qualifying for
17  public office.--
18         (5)(a)  A person who is a subordinate officer, deputy
19  sheriff, or police officer must resign effective upon
20  qualifying pursuant to this chapter if the person is seeking
21  to qualify for a public office that is currently held by an
22  officer who has authority to appoint, employ, promote, or
23  otherwise supervise that person and who has qualified as a
24  candidate for reelection to that office.
25         (b)  Upon qualifying pursuant to this chapter, a
26  subordinate officer, deputy sheriff, or police officer who is
27  seeking public office and who is not required to resign under
28  paragraph (a) must take a leave of absence without pay during
29  the period in which he or she is a candidate for office.
30         Section 2.  This act shall take effect upon becoming a
31  law.
