  1                      A bill to be entitled

  2         An act relating to residential traffic calming

  3         programs; amending s. 318.21, F.S.; authorizing

  4         municipalities to impose a surcharge on civil

  5         penalties for traffic infractions to fund

  6         residential traffic calming programs;

  7         prohibiting the levying of said surcharge on

  8         traffic infractions occurring on certain

  9         highways; requiring the proceeds from such

10         surcharge to be deposited in the Community

11         Traffic Safety Trust Fund; providing for

12         distribution of such funds; providing an

13         effective date.

15  Be It Enacted by the Legislature of the State of Florida:

17         Section 1.  Subsection (13) is added to section 318.21,

18  Florida Statutes, to read:

19         318.21  Disposition of civil penalties by county

20  courts.--All civil penalties received by a county court

21  pursuant to the provisions of this chapter shall be

22  distributed and paid monthly as follows:

23         (13)(a)  A municipality may, by majority vote of the

24  governing board of the municipality, impose a surcharge on the

25  amount of civil penalties required under s. 318.18 for traffic

26  infractions for the sole purpose of funding residential

27  traffic calming programs. The surcharge may not be levied on

28  traffic infractions occurring on public highways or interstate

29  highways. The surcharge must be authorized by ordinance

30  requiring public hearings.

  1         (b)  The proceeds of this surcharge must be placed in a

  2  trust fund established by the governing body of the

  3  municipality called the Community Traffic Safety Trust Fund.

  4  Funds collected from this surcharge must be distributed

  5  quarterly to fund residential traffic calming programs.

  6         Section 2.  This act shall take effect upon becoming a

  7  law.

      Authorizes municipalities to impose a surcharge on civil

      traffic calming programs. Prohibits the levying of said
13    surcharge on traffic infractions occurring on public or
      interstate highways. Requires the proceeds from such
14    surcharge to be deposited in the Community Traffic Safety
