11  Senator Cowin moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 2, between lines 12 and 13,

15

16  insert:

17         Section 2.  Paragraph (e) of subsection (5) section

18  408.039, Florida Statutes, is redesignated as paragraph (f)

19  and a new paragraph (e) is added to subsection (5) of that

20  section to read:

21         408.039  Review process.--The review process for

22  certificates of need shall be as follows:

23         (e)  A hospital may initiate or intervene in an

24  administrative proceeding involving the issuance or denial of

25  a certificate of need for an organ transplantation program

26  upon a showing that an established organ transplantation

27  program at the hospital will be substantially affected by the

28  issuance of the certificate of need to a competing program or

29  facility within the same service planning area delineated

30  under rules adopted by the Agency for Health Care

31  Administration.
