13         Amendment (with title amendment) 

14         On page 66, between lines 22 and 23,

16  insert:

17         Section 38.  Paragraph (q) is added to subsection (3)

18  of section 408.036, Florida Statutes, is amended to read:

19         408.036  Projects subject to review.--

20         (3)  EXEMPTIONS.--Upon request, supported by such

21  documentation as the agency requires, the agency shall grant

22  an exemption from the provisions of subsection (1):

23         (q)  For the construction of a skilled nursing facility

24  of up to 60 beds to be used to serve only retired or disabled

25  military personnel and their surviving spouses. The facility

26  must be constructed by a foundation that was incorporated and

27  operating in this state on or before December 19, 1997, to

28  serve the same population.

30  A request for exemption under this subsection may be made at

31  any time and is not subject to the batching requirements of
