  1                      A bill to be entitled
  2         An act relating to resource recovery and
  3         management; amending s. 403.703, F.S.;
  4         redefining the term "source separated;"
  5         providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:
  8
  9         Section 1.  Subsection (44) of section 403.703, Florida
10  Statutes, is amended to read:
11         403.703  Definitions.--As used in this act, unless the
12  context clearly indicates otherwise, the term:
13         (44)  "Source separated" means the recovered materials
14  are separated from solid waste where the recovered materials
15  and solid waste are generated. The term does not require that
16  various types of recovered materials be separated from each
17  other and recognizes de minimis solid waste, in accordance
18  with industry standards and practices, may be included in the
19  recovered materials. Materials are not considered source
20  separated when two or more types of recovered materials are
21  deposited in combination with each other in a commercial
22  collection container located where the materials are generated
23  and such materials contain more than 10 percent solid waste by
24  volume or weight. For purposes of this subsection, the term
25  "various types of recovered materials" means metals, paper,
26  glass, plastic, textiles, and rubber.
27         Section 2.  This act shall take effect July 1, 2000.

  4  The committee substitute clarifies that materials are not
    considered separated when two or more types of recovered
  5  materials are deposited in combination with each other in a
    commercial collection container that contains more than 10
  6  percent solid waste by volume or weight. For purposes of this
    provision, "various types of recovered materials" means
  7  metals, paper, glass, plastic, textiles, and rubber.
