20         (6)  LIMITATION ON DUPLICATION OF GOVERNMENT

21  REGULATION.--It is the intent of the Legislature to eliminate

22  duplication of regulatory authority over farm operations as

23  expressed herein. Except when the activity of a farm operation

24  takes place within a wellfield protection area as defined in

25  an ordinance adopted by a local government and as otherwise

26  provided for in this section and s. 487.0519(2), and

27  notwithstanding any other providing of law, a local government

28  may not adopt any ordinance, rule, regulation, or policy to

29  prohibit, restrict, regulate or otherwise limit an activity of

30  a bona fide farm operation on land classified as agricultural

31  land pursuant to s. 193.461, where such activity is regulated

 1  through implemented best management practices developed by the

 2  Department of Environmental Protection, the Department of

 3  Agriculture and Consumer Services or water management

 4  districts and adopt pursuant to chapter 120 as part of a

 5  statewide or regional program. The provisions of this

 6  subsection do not apply to powers of local approved

 7  environmental programs authorized by law in s. 403.182.

 8  Nothing in this subsection shall be construed to limit the

 9  powers and duties provided for in s. 373.4592, or to limit the

10  powers and duties of local governments to address emergencies

11  as provided for in chapter 252.
