  1                      A bill to be entitled

  2         An act relating to school emergency

  3         preparedness; amending s. 230.23, F.S.;

  4         requiring district school boards to establish

  5         emergency preparedness procedures for certain

  6         life-threatening emergencies; amending s.

  7         232.465, F.S.; clarifying the requirement that

  8         procedures for life-threatening medical

  9         emergencies be adopted; amending s. 235.14,

10         F.S.; requiring each district school board to

11         adopt emergency management and emergency

12         preparedness procedures according to minimum

13         standards and model procedures established by

14         the Department of Education; providing

15         guidelines for the minimum standards and model

16         procedures adopted by the department; providing

17         an effective date.

19  Be It Enacted by the Legislature of the State of Florida:

20

21         Section 1.  Paragraph (f) is added to subsection (6) of

22  section 230.23, Florida Statutes, to read:

23         230.23  Powers and duties of school board.--The school

24  board, acting as a board, shall exercise all powers and

25  perform all duties listed below:

26         (6)  CHILD WELFARE.--Provide for the proper accounting

27  for all children of school age, for the attendance and control

28  of pupils at school, and for proper attention to health,

29  safety, and other matters relating to the welfare of children

30  in the following fields, as prescribed in chapter 232.

  1         (f)  Emergency management; emergency

  2  preparedness.--Establish emergency management and emergency

  3  preparedness procedures, in accordance with ss. 381.0056(5),

  4  232.465, and 232.475, to be followed by schools for the

  5  following life-threatening emergencies: weapon use/hostage

  6  situations; hazardous materials/toxic spills; weather

  7  emergencies, including hurricanes, tornadoes, and severe

  8  storms; and exposure as a result of a manmade emergency.

  9         Section 2.  Subsection (4) of section 232.465, Florida

10  Statutes, is amended to read:

11         232.465  Provision of medical services; restrictions.--

12         (4)  Each district school board shall establish

13  emergency procedures in accordance with s. 381.0056(5) for

14  life-threatening medical emergencies.

15         Section 3.  Section 235.14, Florida Statutes, is

16  transferred, renumbered as section 232.475, Florida Statutes,

17  and amended to read:

18         232.475 235.14  Emergency management procedures;

19  emergency preparedness drills.--

20         (1)  The Department of Education shall adopt rules

21  which prescribe minimum standards and model procedures for

22  emergency management and emergency preparedness procedures to

23  be adopted by each district school board which must:

24         (a)  Require each school to conduct and document no

25  fewer than 10 fire drills per school year.

26         (b)  Require each school to conduct and document no

27  fewer than 2 tornado drills per school year.

28         (c)  Establish model emergency management and emergency

29  preparedness procedures for the following life-threatening

30  emergencies:

31         1.  Weapon use/hostage situations.

  1         2.  Hazardous materials/toxic spills.

  2         3.  Weather emergencies, including hurricanes,

  3  tornadoes, and severe storms.

  4         4.  Exposure as a result of a manmade emergency.

  5         (2)  Each district school The board shall formulate and

  6  adopt prescribe policies that prescribe emergency management

  7  procedures and procedures for emergency preparedness drills

  8  for each of the schools in the district all the public schools

  9  of the state which comprises comprise grades K-12, according

10  to minimum standards and model policies established by the

11  department according to this section.

12         Section 4.  This act shall take effect July 1, 2000.

14          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
15                             SB 2318

16

17  The committee substitute removes a requirement to establish a
    new component of the school health services plan. The
18  committee substitute also requires that school boards
    establish emergency management and emergency preparedness
19  procedures to be followed by schools for exposure as a result
    of a manmade emergency.
