  1                      A bill to be entitled

  2         An act relating to public records; providing an

  3         exemption from public records requirements for

  4         certain records of an educator who successfully

  5         completes a recovery network treatment program;

  6         providing an expiration date; providing a

  7         finding of public necessity; providing a

  8         contingent effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  The records of an educator who is in a

13  recovery network treatment program after an investigation has

14  commenced or an educator who has entered into a deferred

15  prosecution agreement under section 231.263(6)(c), Florida

16  Statutes, as amended by Senate Bill       , and who

17  successfully completes the recovery network treatment program,

18  are exempt from the disclosure provisions of Section 24(a) of

19  Article I of the State Constitution and section 119.07(1),

20  Florida Statutes. This exemption is subject to the Open

21  Government Sunset Review Act in accordance with section

22  119.15, Florida Statutes, and expires on October 2, 2005,

23  unless reviewed and reenacted by the Legislature.

24         Section 2.  The Legislature finds that it is a public

25  necessity that the records described in section 1 of this act

26  be held confidential in order to promote the rehabilitation of

27  impaired educators. Furthermore, the Legislature finds that it

28  would be an invasion of privacy of participants who

29  successfully complete a recovery network treatment program.

30         Section 3.  This act shall take effect on the effective

31  date of SB       or similar legislation, relating to the

  2  if that legislation does not become a law.

  5                          SENATE SUMMARY

  6    Provides an exemption from public records disclosure
      requirements for specified records of an educator who
  7    successfully completes a recovery network treatment
      program. Provides a finding of public necessity and an
