  1                      A bill to be entitled

  2         An act relating to tobacco; requiring retailers

  3         to keep tobacco products, cigars, cigarettes,

  4         and pipes where they are not easily accessible

  5         to minors; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Limits on minors' access to smoking-related

10  products.--

11         (1)  The owner or manager of a retail establishment in

12  which tobacco products as defined in section 210.25, Florida

13  Statutes, cigarettes as defined in section 210.01, Florida

14  Statutes, or cigars, pipe tobacco, or pipes suitable for

15  smoking are sold shall keep such products behind the counter

16  or in another area of the retail establishment which is

17  inaccessible to customers who are minors.

18         (2)  Any person who violates subsection (1) commits a

19  misdemeanor of the second degree, punishable as provided in

20  section 775.082 or section 775.083, Florida Statutes.

21         Section 2.  This act shall take effect July 1, 2000.
