  2         An act relating to trust funds; re-creating the

  3         Department of Children and Family Services

  4         Tobacco Settlement Trust Fund within the

  5         department without modification; carrying

  6         forward current balances and continuing current

  7         sources and uses thereof; repealing s.

  8         20.195(3), F.S.; abrogating future termination

  9         of the trust fund; providing an effective date.

11         WHEREAS, the Legislature wishes to extend the life of

12  the Department of Children and Family Services Tobacco

13  Settlement Trust Fund within the department, which is

14  otherwise scheduled to be terminated pursuant to

15  constitutional mandate, and

16         WHEREAS, the Legislature has reviewed the trust fund

17  before its scheduled termination date and has found that it

18  continues to meet an important public purpose, and

19         WHEREAS, the Legislature has found that existing public

20  policy concerning the trust fund sets adequate parameters for

21  its use, NOW, THEREFORE,

23  Be It Enacted by the Legislature of the State of Florida:

24

25         Section 1.  (1)  The Department of Children and Family

26  Services Tobacco Settlement Trust Fund within the department,

27  FLAIR number 60-2-122, which is to be terminated pursuant to

28  Section 19(f), Article III of the State Constitution on July

29  1, 2003, is re-created.

  1         (2)  All current balances of the trust fund are carried

  2  forward, and all current sources and uses of the trust fund

  3  are continued.

  4         Section 2.  Subsection (3) of section 20.195, Florida

  5  Statutes, is repealed.

  6         Section 3.  This act shall take effect November 4,

  7  2000.
