11  Senator Dyer moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 57, between lines 15 and 16,

15

16  insert:

17         Section 35.  Subsection (1) of section 190.012, Florida

18  Statutes, is amended to read:

19         190.012  Special powers; public improvements and

20  community facilities.--The district shall have, and the board

21  may exercise, subject to the regulatory jurisdiction and

22  permitting authority of all applicable governmental bodies,

23  agencies, and special districts having authority with respect

24  to any area included therein, any or all of the following

25  special powers relating to public improvements and community

26  facilities authorized by this act:

27         (1)  To finance, fund, plan, establish, acquire,

28  construct or reconstruct, enlarge or extend, equip, operate,

29  and maintain systems, facilities, and basic infrastructures

30  for the following:

31         (a)  Water management and control for the lands within

 1  the district and to connect some or any of such facilities

 2  with roads and bridges.

 3         (b)  Water supply, sewer, and wastewater management,

 4  reclamation, and reuse or any combination thereof, and to

 5  construct and operate connecting intercepting or outlet sewers

 6  and sewer mains and pipes and water mains, conduits, or

 7  pipelines in, along, and under any street, alley, highway, or

 8  other public place or ways, and to dispose of any effluent,

 9  residue, or other byproducts of such system or sewer system.

10         (c)  Bridges or culverts that may be needed across any

11  drain, ditch, canal, floodway, holding basin, excavation,

12  public highway, tract, grade, fill, or cut and roadways over

13  levees and embankments, and to construct any and all of such

14  works and improvements across, through, or over any public

15  right-of-way, highway, grade, fill, or cut.

16         (d)1.  District roads equal to or exceeding the

17  specifications of the county in which such district roads are

18  located, and street lights.

19         2.  Buses, trolleys, transit shelters, ridesharing

20  facilities and services, parking improvements, and related

21  signage.

22         (e)  Investigation and remediation costs associated

23  with the cleanup of actual or perceived environmental

24  contamination within the district under the supervision or

25  direction of a competent governmental authority unless the

26  covered costs benefit any person who is a landowner within the

27  district and who caused or contributed to the contamination.

28         (f)(e)  Conservation areas, mitigation areas, and

29  wildlife habitat, including the maintenance of any plant or

30  animal species, and any related interest in real or personal

31  property.

 1         (g)(f)  Any other project within or without the

 2  boundaries of a district when a local government issued a

 3  development order pursuant to s. 380.06 or s. 380.061

 4  approving or expressly requiring the construction or funding

 5  of the project by the district, or when the project is the

 6  subject of an agreement between the district and a

 7  governmental entity and is consistent with the local

 8  government comprehensive plan of the local government within

 9  which the project is to be located.
