  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Digital Divide Trust Fund in the State

  4         Technology Office; providing for sources of

  5         moneys and purposes; providing for

  6         administration of the fund; providing for

  7         future review and termination or re-creation of

  8         the trust fund; providing a contingent

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  (1)  The Digital Divide Trust Fund is

14  created in the State Technology Office for the purpose of

15  receiving and disbursing funds required to pay part or all of

16  the costs of facilitating design and implementation of one or

17  more programs using information technology to educate and

18  train members of economically disadvantaged families to become

19  qualified to compete effectively for high-skill, high-wage

20  employment opportunities in the information technology

21  industry in this state. The trust fund shall be administered

22  by the Digital Divide Council in the State Technology Office.

23         (2)  There is hereby transferred $3 million of

24  Temporary Assistance to Needy Families funds in the Employment

25  Security Administration Trust Fund within the Agency for

26  Workforce Innovation to the Digital Divide Trust Fund. The

27  Digital Divide Trust Fund may also receive additional funding

28  lawfully made from other sources, including, but not limited

29  to, other and further appropriations from the state and gifts,

30  donations, and matching contributions from other public

31  agencies and private persons and entities.

  1         Section 2.  (1)  Pursuant to the provisions of Section

  2  19(f)(2), Article III of the State Constitution, the Digital

  3  Divide Trust Fund shall, unless terminated sooner, be

  4  terminated July 1, 2005.

  5         (2)  Prior to the regular legislative session

  6  immediately preceding the date on which the trust fund is

  7  scheduled to be terminated, the State Technology Office and

  8  the Governor shall recommend to the President of the Senate

  9  and the Speaker of the House of Representatives whether the

10  trust fund should be allowed to terminate or should be

11  re-created.  These recommendations shall be based on a review

12  of the purpose and use of the trust fund and a determination

13  of whether the trust fund will continue to be necessary.  A

14  recommendation to re-create the trust fund may include

15  suggested modifications to the purposes, sources of receipts,

16  and allowable expenditures for the trust fund.  The State

17  Technology Office's recommendation shall be made as a part of

18  its legislative budget request to the Legislature pursuant to

19  section 216.023, Florida Statutes.  The Governor's

20  recommendation shall be made as a part of the recommended

21  budget presented to the Legislature pursuant to section

22  216.162, Florida Statutes.

23         (3)  If the trust fund is terminated, the State

24  Technology Office shall pay any outstanding debts or

25  obligations of the trust fund as soon as practicable and the

26  Comptroller shall close out and remove the trust fund from the

27  various state accounting systems, using generally accepted

28  accounting practices concerning warrants outstanding, assets,

29  and liabilities.

  1         Section 3.  This act shall take effect July 1, 2001, if

  2  HB 1045 or similar legislation is adopted in the same

  3  legislative session or an extension thereof.
