  1                      A bill to be entitled

  2         An act relating to sentencing; amending s.

  3         921.0022, F.S.; authorizing the state and

  4         defendant to waive preparation of a worksheet

  5         and scoresheet under the Criminal Punishment

  6         Code and for the court to impose a sentence;

  7         requiring that the scoresheet be filed within a

  8         specified period after sentencing; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Subsection (1) of section 921.0022, Florida

14  Statutes, is amended to read:

15         921.0022  Criminal Punishment Code; offense severity

16  ranking chart.--

17         (1)  The offense severity ranking chart must be used

18  with the Criminal Punishment Code worksheet to compute a

19  sentence score for each felony offender whose offense was

20  committed on or after October 1, 1998. However, the state and

21  the defendant may waive the presentencing preparation of a

22  Criminal Punishment Code worksheet and scoresheet and the

23  court shall proceed to sentence the defendant. The scoresheet

24  must be prepared and filed within 14 days after sentencing in

25  accordance with other requirements of this chapter.

26         Section 2.  This act shall take effect July 1, 2001.

                       COMMITTEE SUBSTITUTE FOR
  2                         Senate Bill 1196

  4  -     The CS deletes the provision in the bill that allowed
          the court to impose a sentence, regardless of the
  5        sentencing score, if the state and the defendant waive
          preparation of the scoresheet.
  6
    -     The CS adds the provision that the defendant and the
  7        state may waive the presentencing preparation of the
          scoresheet, but that the scoresheet must ultimately be
  8        prepared and filed within 14 days of sentencing.
