    Representatives Dockery, Greenstein, Kendrick, Mayfield,
    Holloway, Lee, Bennett, Harrell and Brown




  1                      A bill to be entitled

  2         An act relating to trust funds; re-creating the

  3         Public Facilities Financing Trust Fund within

  4         the Department of Management Services without

  5         modification and placing it on the standard

  6         review cycle; carrying forward current balances

  7         and continuing current sources and uses

  8         thereof; providing an effective date.

  9

10         WHEREAS, the Legislature wishes to extend the life of

11  the Public Facilities Financing Trust Fund within the

12  Department of Management Services, which is otherwise

13  scheduled to be terminated pursuant to constitutional mandate,

14  and

15         WHEREAS, the Legislature has reviewed the trust fund

16  before its scheduled termination date and has found that it

17  continues to meet an important public purpose, and

18         WHEREAS, the Legislature has found that existing public

19  policy concerning the trust fund sets adequate parameters for

20  its use, NOW, THEREFORE,

22  Be It Enacted by the Legislature of the State of Florida:

23

24         Section 1.  (1)  The Public Facilities Financing Trust

25  Fund within the Department of Management Services, FLAIR

26  number 72-2-495, which is to be terminated pursuant to Section

27  19(f), Article III of the State Constitution in 2005, unless

28  terminated sooner by law, is terminated on November 4, 2004,

29  and re-created.

  1         (2)  All current balances of the trust fund are carried

  2  forward, and all current sources and uses of the trust fund

  3  are continued.

  4         Section 2.  This act shall take effect November 4,

  5  2004.
