  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Comprehensive Child and Adolescent Mental

  4         Health Services Trust Fund within the

  5         Department of Children and Family Services;

  6         providing for sources of moneys and purposes;

  7         providing for future review and termination or

  8         re-creation of the trust fund; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Comprehensive Child and Adolescent Mental

14  Health Services Trust Fund.--

15         (1)  The Comprehensive Child and Adolescent Mental

16  Health Services Trust Fund is created in the State Treasury,

17  to be administered by the Department of Children and Family

18  Services. Funds credited to the trust fund shall be used to

19  administer part III of chapter 394, Florida Statutes, the

20  "Comprehensive Child and Adolescent Mental Health Services

21  Act."

22         (2)  Funds budgeted for child and adolescent mental

23  health treatment may be transferred to the trust fund and used

24  to implement part III of chapter 394, Florida Statutes.

25  Additional funds, including state-appropriated funds, may be

26  placed in the trust fund and used as provided in this section.

27         (3)  All funds transferred to and retained in the trust

28  fund shall be invested pursuant to section 18.125, Florida

29  Statutes. Any interest accruing to the trust fund shall be

30  used for child and adolescent mental health treatment.

31  Notwithstanding section 216.301, Florida Statutes, and

  1  pursuant to section 216.351, Florida Statutes, any undisbursed

  2  balance remaining in the trust fund and interest accruing to

  3  the trust fund which is not distributed at the end of the

  4  fiscal year shall remain in the trust fund and shall increase

  5  the total funds available for child and adolescent mental

  6  health treatment programs.

  7         Section 2.  Pursuant to section 19(f)(2), Article III

  8  of the State Constitution, the Comprehensive Child and

  9  Adolescent Mental Health Services Trust Fund shall, unless

10  terminated sooner, be terminated on July 1, 2005. Prior to its

11  scheduled termination, the trust fund shall be reviewed as

12  provided in section 215.3206(1) and (2), Florida Statutes.

13         Section 3.  This act shall take effect July 1, 2001.

16                          SENATE SUMMARY

17    Creates the Comprehensive Child and Adolescent Mental
      Health Services Trust Fund within the Department of
18    Children and Family Services. Requires that the trust
      fund be used to administer part III, ch. 394, F.S., the
19    Comprehensive Child and Adolescent Mental Health Services
      Act. Provides for future legislative review and
20    termination or re-creation of the trust fund.
