  1                      A bill to be entitled

  2         An act creating the Phosphogypsum Stack System

  3         Safety Assurance Trust Fund; providing for its

  4         purpose and source of moneys; providing for

  5         review and termination or re-creation of the

  6         trust fund; providing a contingent effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  In accordance with section 215.3207,

12  Florida Statutes, the Phosphogypsum Stack System Safety

13  Assurance Trust Fund is created to be administered by the

14  Department of Environmental Protection. The purpose of the

15  trust fund is to provide funds to abate or substantially

16  reduce any imminent hazard caused by the physical condition or

17  operation of a phosphogypsum stack system to the extent

18  provided in section 403.4154, Florida Statutes. The source of

19  the moneys to be credited to the trust fund are the

20  registration fees provided by section 403.4154, Florida

21  Statutes. Any interest accruing on funds maintained in the

22  trust fund shall be credited to the trust fund.

23         Section 2.  In accordance with Section 19(f)(2),

24  Article III of the State Constitution, the Phosphogypsum Stack

25  System Safety Assurance Trust Fund shall be terminated on July

26  1, 2005, unless terminated sooner. Before its scheduled

27  termination, the trust fund shall be reviewed as provided in

28  section 215.3206(1) and (2), Florida Statutes.

29         Section 3.  This act shall take effect on the effective

30  date of Senate Bill _____, but it shall not take effect unless

31  it is enacted by a three-fifths vote of the membership of each
