  1                      A bill to be entitled

  2         An act relating to high-occupancy vehicle

  3         lanes; amending s. 316.0741, F.S.; allowing

  4         certain energy-saving vehicles to travel in

  5         such lanes, regardless of occupancy; providing

  6         an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsection (4) is added to section

11  316.0741, Florida Statutes, to read:

12         316.0741  High occupancy vehicle lanes.--

13         (4)  Notwithstanding provisions of this section to the

14  contrary, an inherently low-emission vehicle (ILEV) that is

15  certified and labeled in accordance with federal regulations

16  may be driven in an HOV lane at any time, regardless of its

17  occupancy. The department shall issue a decal to be placed on

18  such vehicles authorizing such use.

19         Section 2.  This act shall take effect July 1, 2001.

                       COMMITTEE SUBSTITUTE FOR
22                              SB 146

24  The CS authorizes the use of High Occupancy Vehicle lanes,
    regardless of vehicle occupancy, by Inherently Low-Emission
25  Vehicle (ILEV) which are certified and labeled in accordance
    with federal regulations.  The CS requires the Department of
26  Highway Safety and Motor Vehicles to issue a decal to be
    placed on authorized ILEVs.
