  1                      A bill to be entitled

  2         An act relating to public records exemptions;

  3         exempting armed forces form DD-214 from

  4         disclosure when filed with the clerk of the

  5         court; providing exceptions; providing for

  6         future review and repeal; providing findings of

  7         public necessity; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  United States armed forces form DD-214,

12  when filed with the clerk of the court, is confidential and

13  exempt from section 119.07(1), Florida Statutes, and Section

14  24(a), Article I of the State Constitution. However,

15  information contained in that form may be released to a

16  personal representative, executor, or court-appointed guardian

17  of the person. This section is subject to the Open Government

18  Sunset Review Act of 1995 in accordance with section 119.15,

19  Florida Statutes, and shall stand repealed on October 2, 2006,

20  unless reviewed and saved from repeal through reenactment by

21  the Legislature.

22         Section 2.  The Legislature finds that exempting

23  information contained in United States armed forces form

24  DD-214 is a public necessity. The information is of a personal

25  nature, and the potential harm resulting from its disclosure

26  is not offset by any possible public benefit.

27         Section 3.  This act shall take effect July 1, 2001.
