1 A bill to be entitled
2 An act relating to the Division of Dairy
3 Industry of the Department of Agriculture and
4 Consumer Services; eliminating the Division of
5 Dairy Industry; repealing ss. 570.40 and
6 570.41, F.S., relating to the powers and duties
7 of the Division of Dairy Industry and the
8 qualifications and duties of the director of
9 the Division of Dairy Industry; amending ss.
10 20.14, 570.18, and 570.29, F.S., to conform;
11 amending s. 570.50, F.S.; including the powers
12 and duties of the Division of Dairy Industry
13 within the powers and duties assigned to the
14 Division of Food Safety of the Department of
15 Agriculture and Consumer Services; providing an
16 effective date.

18 Be It Enacted by the Legislature of the State of Florida:
19
20 Section 1. Sections 570.40 and 570.41, Florida
21 Statutes, are repealed.
22 Section 2. Subsection (2) of section 20.14, Florida
23 Statutes, is amended to read:
24 20.14 Department of Agriculture and Consumer
25 Services.--There is created a Department of Agriculture and
26 Consumer Services.
27 (2) The following divisions of the Department of
28 Agriculture and Consumer Services are established:
29 (a) Administration.
30 (b) Agricultural Environmental Services.
31 (c) Animal Industry.

1 (d) Aquaculture.
2 (e) Consumer Services.
3 (f) Dairy Industry.
4 (f)(g) Food Safety.

7 (i)(j) Marketing and Development.
8 (j)(k) Plant Industry.
9 (k)(l) Standards.
10 Section 3. Section 570.29, Florida Statutes, is
11 amended to read:
12 570.29 Departmental divisions.--The department shall
13 include the following divisions:
14 (1) Administration.
15 (2) Agricultural Environmental Services.
16 (3) Animal Industry.
17 (4) Aquaculture.
18 (5) Consumer Services.
19 (6) Dairy Industry.
20 (6)(7) Food Safety.
21 (7)(8) Forestry.
22 (8)(9) Fruit and Vegetables.
23 (9)(10) Marketing and Development.
24 (10)(11) Plant Industry.
25 (11)(12) Standards.
26 Section 4. Section 570.18, Florida Statutes, is
27 amended to read:
28 570.18 Organization of departmental work.--In the
29 assignment of functions to the 11 12 divisions of the
30 department created in s. 570.29, the department shall retain
31 within the Division of Administration, in addition to

1 executive functions, those powers and duties enumerated in s.
2 570.30. The department shall organize the work of the other 10
3 11 divisions in such a way as to secure maximum efficiency in
4 the conduct of the department. The divisions created in s.
5 570.29 are solely to make possible the definite placing of
6 responsibility. The department shall be conducted as a unit in
7 which every employee, including each division director, is
8 assigned a definite workload, and there shall exist between
9 division directors a spirit of cooperative effort to
10 accomplish the work of the department.
11 Section 5. Subsections (6) and (7) are added to
12 section 570.50, Florida Statutes, to read:
13 570.50 Division of Food Safety; powers and
14 duties.--The duties of the Division of Food Safety include,
15 but are not limited to:
16 (6) Inspecting dairy farms of the state, enforcing
17 those provisions of chapter 502 as are authorized by the
18 department, enforcing the law relating to inspection for
19 detection of mastitis in dairy cattle and relating to
20 supervision of milking operations, and enforcing rules adopted
21 pursuant to such law.
22 (7) Inspecting milk plants, milk product plants, and
23 plants engaged in the manufacture and distribution of frozen
24 desserts and frozen desserts mix; analyzing and testing
25 samples of milk, milk products, frozen desserts, and frozen
26 desserts mix collected by it; and enforcing those provisions
27 of chapters 502 and 503 as are authorized by the department.
28 Section 6. This act shall take effect July 1, 2001.
