  1                      A bill to be entitled

  2         An act relating to the central voter file;

  3         amending s. 98.0975, F.S.; modifying

  4         requirements of the Division of Elections with

  5         respect to the information on persons included

  6         in the central voter file to be reported to the

  7         county supervisors of elections; eliminating

  8         the requirement for the division to annually

  9         contract with a private entity to provide list

10         maintenance duties on the central voter file;

11         providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  Section 98.0975, Florida Statutes, is

16  amended to read:

17         98.0975  Central voter file; periodic list

18  maintenance.--

19         (1)(a)  By August 15, 1998, the division shall provide

20  to each county supervisor of elections a list containing the

21  name, address, date of birth, race, gender, and any other

22  available identifying information identifying the voter of

23  each person included in the central voter file as a registered

24  voter in the supervisor's county who the division believes may

25  be ineligible to vote based on examination of data obtained

26  from the Florida Department of Law Enforcement, the Board of

27  Executive Clemency, the Office of Vital Statistics, or any

28  other source which indicates that the person:

29         1.(a)  Is deceased;

30         2.(b)  Has been convicted of a felony and has not had

31  his or her civil rights restored; or

  1         3.(c)  Has been adjudicated mentally incompetent and

  2  whose mental capacity with respect to voting has not been

  3  restored.

  4         (b)(2)  The division shall annually update the

  5  information required in paragraph (a) subsection (1) and

  6  forward a like list to each supervisor by June 1 of each year.

  7         (3)(a)  In order to meet its obligations under this

  8  section, the division shall annually contract with a private

  9  entity to compare information in the central voter file with

10  available information in other computer databases, including,

11  without limitation, databases containing reliable criminal

12  records and records of deceased persons.

13         (b)  The entity contracted by the division is

14  designated as an agent of the division for purposes of

15  administering the contract, and must be limited to seeking

16  only that information which is necessary for the division to

17  meet its obligations under this section. Information obtained

18  under this section may not be used for any purpose other than

19  determining voter eligibility.

20         (2)(4)  Upon receiving the list from the division, the

21  supervisor must attempt to verify the information provided. If

22  the supervisor determines does not determine that the

23  information provided by the division is correct incorrect, the

24  supervisor must remove from the registration books by the next

25  subsequent election the name of any person who the supervisor

26  confirms is deceased, has been convicted of a felony and has

27  not had his or her civil rights restored, or has been

28  adjudicated mentally incapacitated with respect to voting and

29  has not had his or her mental capacity with respect to voting

30  restored.

31         Section 2.  This act shall take effect July 1, 2001.
