18 Section 10. Section 409.91195, Florida Statutes, is
19 amended to read:
20 409.91195 Medicaid Pharmaceutical and Therapeutics
21 Committee; Medicaid restricted drug formulary.--There is
22 created a Medicaid Pharmaceutical and Therapeutics Committee
23 in accordance with federal requirements for the purpose of
24 developing a Medicaid restricted drug formulary for
25 prescriptions exceeding four (4) brand name drugs per patient
26 per month. The committee shall develop and implement a
27 voluntary Medicaid preferred prescribed drug designation
28 program. The program established under this section shall
29 provide information to Medicaid providers on medically
30 appropriate and cost-efficient prescription drug therapies
31 through the development and publication of a Medicaid

2 prescribed-drug list.
3 (1) The Medicaid Pharmaceutical and Therapeutics
4 Committee shall be comprised of nine members appointed as
5 follows: one practicing physician licensed under chapter 458,
6 appointed by the Speaker of the House of Representatives from
7 a list of recommendations from the Florida Medical
8 Association; one practicing physician licensed under chapter
9 459, appointed by the Speaker of the House of Representatives
10 from a list of recommendations from the Florida Osteopathic
11 Medical Association; one practicing physician licensed under
12 chapter 458, appointed by the President of the Senate from a
13 list of recommendations from the Florida Academy of Family
14 Physicians; one practicing podiatric physician licensed under
15 chapter 461, appointed by the President of the Senate from a
16 list of recommendations from the Florida Podiatric Medical
17 Association; one trauma surgeon licensed under chapter 458,
18 appointed by the Speaker of the House of Representatives from
19 a list of recommendations from the American College of
20 Surgeons; one practicing dentist licensed under chapter 466,
21 appointed by the President of the Senate from a list of
22 recommendations from the Florida Dental Association; one
23 practicing pharmacist licensed under chapter 465, appointed by
24 the Governor from a list of recommendations from the Florida
25 Pharmacy Association; one practicing pharmacist licensed under
26 chapter 465, appointed by the Governor from a list of
27 recommendations from the Florida Society of Health System
28 Pharmacists; and one health care professional with expertise
29 in clinical pharmacology appointed by the Governor from a list
30 of recommendations from the Pharmaceutical Research and
31 Manufacturers Association. The members shall be appointed to

1 serve for terms of 2 years from the date of their appointment.
2 Members may be appointed to more than one term. The Agency for
3 Health Care Administration shall serve as staff for the
4 committee and assist them with all ministerial duties.
5 (2) With the advice of Upon recommendation by the
6 committee, the Agency for Health Care Administration shall
7 establish a Medicaid restricted drug formulary the voluntary
8 Medicaid preferred prescribed-drug list. Upon further
9 recommendation by the committee, the agency shall add to,
10 delete from, or modify the list. The committee shall also
11 review requests for additions to, deletions from, or
12 modifications of the formulary as presented to it by the
13 agency; and, upon further recommendation by the committee, the
14 agency shall add to, delete from, or modify the formulary as
15 appropriate list. The list shall be adopted by the committee
16 in consultation with medical specialists, when appropriate,
17 using the following criteria: use of the list shall be
18 voluntary by providers and the list must provide for medically
19 appropriate drug therapies for Medicaid patients which achieve
20 cost savings in the Medicaid program.
21 (3) The Agency for Health Care Administration shall
22 publish and disseminate the Medicaid restricted drug formulary
23 voluntary Medicaid preferred prescribed drug list to all
24 Medicaid prescribing providers in the state.
