14 On page 102, between lines 5 and 6 of the bill
15
16 insert:
17 408.035 Review criteria.--The agency shall determine
18 the reviewability of applications and shall review
19 applications for certificate-of-need determinations for health
20 care facilities and health services in context with the
21 following criteria:
22 (1) The need for the health care facilities and health
23 services being proposed in relation to the applicable district
24 health plan.
25 (2) The availability, quality of care, accessibility,
26 and extent of utilization of existing health care facilities
27 and health services in the service district of the applicant.
28 (3) The ability of the applicant to provide quality of
29 care and the applicant's record of providing quality of care.
30 (4) The need in the service district of the applicant
31 for special health care services that are not reasonably and

1 economically accessible in adjoining areas.
2 (5) The needs of research and educational facilities,
3 including, but not limited to, facilities with institutional
4 training programs and community training programs for health
5 care practitioners and for doctors of osteopathic medicine and
6 medicine at the student, internship, and residency training
7 levels.
8 (6) The availability of resources, including health
9 personnel, management personnel, and funds for capital and
10 operating expenditures, for project accomplishment and
11 operation.
12 (7) The extent to which the proposed services will
13 enhance access to health care for residents of the service
14 district.
15 (8) The immediate and long-term financial feasibility
16 of the proposal.
17 (9) The extent to which the proposal will foster
18 competition that promotes quality and cost-effectiveness.
19 (10) The costs and methods of the proposed
20 construction, including the costs and methods of energy
21 provision and the availability of alternative, less costly, or
22 more effective methods of construction.
23 (11) The applicant's past and proposed provision of
24 health care services to Medicaid patients and the medically
25 indigent.
26 (12) The applicant's designation as a Gold Seal
27 Program nursing facility pursuant to s. 400.235, when the
28 applicant is requesting additional nursing home beds at that
29 facility.
30 (13) The applicant is a 501(c)(3) charitable
31 organization sponsored by a religious or fraternal group and

1 has a history of community involvement evidenced by:
2 (a) an active volunteer services program,
3 (b) an active Resident and Family Care Council, and
4 (c) a history of providing care for indigent persons
