18 and insert:
19 Section 1. Paragraph (f) of subsection (37) of section
20 440.02, Florida Statutes, is repealed.
21 Section 2. Limitation on construction industry
22 business activities; penalties.--
23 (1) Notwithstanding any other provision of chapter
24 440, Florida Statutes, with respect to persons and entities
25 actively engaged in the construction industry, a corporation,
26 partnership, sole proprietorship, or independent contractor
27 that fails to maintain coverage or is otherwise without
28 coverage required by chapter 440, Florida Statutes, may not
29 enter into a contract, subcontract, or other business
30 relationship, for the purposes of construction, with another
31 corporation, partnership, sole proprietorship, or independent

1 contractor.
2 (2) Any sole proprietor or partner of a business
3 actively engaged in the construction industry who violates
4 subsection (1) shall immediately forfeit any election of
5 exclusion or election of exemption available under chapter
6 440, Florida Statutes, and may not elect or receive an
7 exclusion or exemption from the requirements of chapter 440,
8 Florida Statutes, for a period of 5 years following the date
9 of the violation.
10 (3) Any corporate officer of a corporation actively
11 engaged in the construction industry who violates subsection
12 (1) shall immediately forfeit any election of exclusion or
13 election of exemption available under chapter 440, Florida
14 Statutes, and may not elect or receive an exclusion or
15 exemption from the requirements of chapter 440, Florida
16 Statutes, for a period of 5 years following the date of the
17 violation.
