11  Senator Diaz de la Portilla moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 21, between lines 11 and 12,
15  
16  insert:  
17         Section 13.  In order to avoid duplicative regulation
18  that impedes the economic development of businesses in this
19  state, and notwithstanding any other provision of law, the
20  Division of Alcoholic Beverages and Tobacco of the Department
21  of Business and Professional Regulation shall have sole and
22  exclusive authority within this state to regulate the display
23  of tobacco products as defined in section 569.002(6), Florida
24  Statutes, by retail tobacco products dealers as defined in
25  section 569.002(4), Florida Statutes, provided that the
26  authority conferred on the department by this section is the
27  authority to issue such rules and regulations as may be
28  necessary to administer and enforce the provisions of section
29  569.007(1)(a), Florida Statutes.
