13         Senate Amendment (with title amendment) 
14         On page 139, between lines 24 and 25,
15  
16  insert:  
17         Section 78.  (1)  The Legislature recognizes that
18  municipalities, counties, and other governmental entities are
19  empowered to alter or remove signs along roadways for a public
20  purpose and with just compensation, and that such compensation
21  includes amortization or monetary compensation. Further, the
22  Legislature recognizes compensation by amortization may
23  burden, restrict, or limit private property rights. The
24  Legislature therefore determines that there is an important
25  state interest in balancing private property owners' rights
26  and the responsibility of municipalities, counties, and other
27  governmental entities to enhance the safety and aesthetics of
28  their communities.
29         (2)  The Sign Valuation Task Force is created and shall
30  be staffed by the Department of Transportation. The task force
31  is charged with developing formulas for providing just

The task force shall consider whether amortization 3 periods should include a premium in recognition of a potential 4 burden upon private property owners' rights due to the private 5 property owners being compelled by amortization to earn their 6 own compensation. 7 (a) The task force shall be composed of five members. 8 The President of the Senate and the Speaker of the House of 9 Representatives shall each appoint two members. The remaining 10 member shall be appointed by the Secretary of Transportation 11 and shall be an appraiser who is a member of the Appraisal 12 Institute. The task force members shall select a chair of the 13 task force. All appointments must be made by July 15, 2001. 14 Three members of the task force shall constitute a quorum, and 15 the vote of three members shall be necessary for any action 16 taken by the task force. The task force may meet upon the 17 constitution of a quorum. 18 (b) Upon the appointment of the members, the task 19 force shall schedule an organizational meeting to be held no 20 later than August 1, 2001. Thereafter, the task force shall 21 meet at least three times, preferably at various locations 22 throughout the state. The task force may meet by 23 teleconference. 24 (c) Members of the task force from the private sector 25 are not entitled to per diem or reimbursement for travel 26 expenses; however, members of the task force from the public 27 sector are entitled to reimbursement, if any, from their 28 respective agencies. SENATE AMENDMENT Bill No. CS for CS for SB 2056 Amendment No. ___ Barcode 182068 1 sign valuation methods and methods of providing compensation. 2 In its review, the task force shall analyze existing laws of 3 this state, of other states, and of the Federal Government, 4 including existing case law, all sign appraisal valuation 5 methods, methods of providing compensation, and other related 6 issues. 7 (e) The task force may conduct meetings, hearings, and 8 workshops in Tallahassee and at other locations around the 9 state, and may take evidence, testimony and debate at the 10 meetings, hearings, and workshops. The task force must keep 11 electronic recordings of the meetings, hearings, and 12 workshops. Such recordings shall be preserved under chapters 13 119 and 257, Florida Statutes. 14 (f) The task force shall submit its findings and 15 recommendations in the form of a written report to the 16 President of the Senate, the Speaker of the House of 17 Representatives, and the Governor by December 15, 2001.
