  1                      A bill to be entitled

  2         An act relating to motor vehicle airbag

  3         replacement; creating s. 860.146, F.S.;

  4         prohibiting the replacement of an airbag with

  5         anything other than a bona fide new airbag;

  6         providing a penalty; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 860.146, Florida Statutes, is

12  created to read:

13         860.146  Airbag replacement.--It is unlawful for any

14  person to replace a deployed or defective airbag in a motor

15  vehicle inflatable restraint system with anything other than a

16  bona fide new airbag. Any person who violates this section

17  commits a felony of the third degree, punishable as provided

18  in s. 775.082, s. 775.083, or s. 775.084.

19         Section 2.  This act shall take effect July 1, 2001.
