  2         An act relating to Broward County; authorizing

  3         local governments in the county to grant an

  4         exception from the concurrency requirement for

  5         transportation facilities under s. 163.3180,

  6         F.S., for certain developments; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  In addition to the exceptions provided in

12  section 163.3180(5)(b), Florida Statutes, a local government

13  in Broward County may grant an exception from the concurrency

14  requirement for transportation facilities pursuant to the

15  provisions of section 163.3180(5)(d), Florida Statutes, if the

16  proposed development is otherwise consistent with the adopted

17  local government comprehensive plan, and is a project that

18  promotes public transportation and is located within a

19  Regional Activity Center as described in and defined by the

20  Broward County Comprehensive Plan, and is within an area that

21  contains major public and private postsecondary institutions

22  of higher learning. The local government also must have

23  considered the proposed development's impacts on the Florida

24  Intrastate Highway System, as defined in section 338.001,

25  Florida Statutes.

26         Section 2.  This act shall take effect upon becoming a

27  law.
