17 and insert in lieu thereof: (c) "Eligible nonprofit
18 scholarship funding organization" means a charitable
19 organization that is exempt from federal income tax pursuant
20 to s. 501(c)(3) of the Internal Revenue Code and, in the
21 administration of educational scholarships, does not
22 discriminate upon the basis of religious conviction, race,
23 color, sex, national origin, or physical disability, except
24 that the mere separation of the sexes shall not be considered
25 discrimination. An eligible nonprofit scholarship funding
26 organization shall provide educational scholarships that allow
27 students to attend any eligible nonpublic school of their
28 parent's choice and shall not prohibit parental choice by
29 limiting scholarships to any school. In addition, an eligible
30 organization shall comply with the provisions of subsection
31 (4).
