13 Amendment (with title amendment)
14 On page 1, line 31, of the bill
15
16 insert:
17 Section 2. Law enforcement officers, civil or criminal
18 action against; employer payment of costs and attorney's
19 fees.--
20 (1) For the purpose of this act, "law enforcement
21 officer" means any person employed full time by any
22 municipality or the state or any political subdivision thereof
23 or any deputy sheriff whose primary responsibility is the
24 prevention and detection of crime or the enforcement of the
25 penal, traffic, or highway laws of this state.
26 (2) The employing agency of any law enforcement
27 officer shall pay the legal costs and reasonable attorney's
28 fees for any law enforcement officer in any civil or criminal
29 action commenced against such law enforcement officer in any
30 court when the action arose out of the performance of the
31 officer's official duties and:

1 (a) The plaintiff requests dismissal of the suit; or
2 (b) Such law enforcement officer is found to be not
3 liable or not guilty.
