15         On page 2, lines 4-10, delete those lines

17  and insert:

18         (3)  This section does not prohibit an action against a

19  manufacturer, distributor, or dealer regarding:

20         (a)  A breach of contract or warranty in connection

21  with a product purchased by a county, municipality, special

22  district, or other political subdivision or agency of the

23  state;

24         (b)  Injuries resulting from a defective product;

25         (c)  Injuries resulting from a failure to warn; or

26         (d)  A product that is discovered to cause unintended

27  harm where the risk of such harm is not obvious or known to

28  the user of the product and where, because of the risk or such

29  unintended harm, action by a governmental entity is needed to

30  protect the public.
