17  and insert in lieu thereof:  
18         (6)  Subsections (1) and (3) do not apply to the
19  creation, attachment, perfection, or enforcement of a security
20  interest in:
21         (a)  A claim or right to receive compensation for
22  injuries or sickness as described in 26 U.S.C. subsection
23  104(a)(1) or (2).
24         (b)  A claim or right to receive benefits under a
25  special needs trust as described in 42 U.S.C. subsection
26  1396p(d)(4).
27         (c)  The interest of a debtor who is a natural person
28  in unemployment, alimony, disability, pension, or retirement
29  benefits or victim compensation funds.
30         (d)  The interest of a debtor who is a natural person
31  in other benefits which are designated solely for his or her

 1  maintenance, support, or education, the assignability of which
 2  is expressly prohibited or restricted by statute.
 3  
 4  However, this provision shall not preclude such debtor's
 5  creation, attachment, perfection, or enforcement of a security
 6  interest in a settlement arising from a personal injury claim
 7  other than one against an employer arising out of the debtor's
 8  employment.
 9         (7)  Subsections (1), (3), and (6) apply only to a
10  security interest created after January 1, 2002.
