  1                      A bill to be entitled

  2         An act relating to public records; amending s.

  3         119.07, F.S.; abrogating the repeal scheduled

  4         under the Open Government Sunset Review Act of

  5         1995 of the exemption from the public-records

  6         requirements for bank account numbers or debit,

  7         charge, or credit card numbers given to an

  8         agency for payment of a fee or debt; providing

  9         an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Paragraph (z) of subsection (3) of section

14  119.07, Florida Statutes, is amended to read:

15         119.07  Inspection, examination, and duplication of

16  records; exemptions.--

17         (3)

18         (z)  Bank account numbers or debit, charge, or credit

19  card numbers given to an agency for the purpose of payment of

20  any fee or debt owing are confidential and exempt from

21  subsection (1) and s. 24(a), Art. I of the State Constitution.

22  However, such numbers may be used by an agency, as needed, in

23  any administrative or judicial proceeding, provided such

24  numbers are kept confidential and exempt, unless otherwise

25  ordered by the court. This paragraph is subject to the Open

26  Government Sunset Review Act of 1995 in accordance with s.

27  119.15, and shall stand repealed on October 2, 2001, unless

28  reviewed and saved from repeal through reenactment by the

29  Legislature.

30         Section 2.  This act shall take effect October 1, 2001.
