11 The Council for Healthy Communities offered the following:

13 Amendment (with title amendment)
14 Remove from the bill: Everything after the enacting clause

16 and insert in lieu thereof:
17 Section 1. The Board of Pharmacy and the Board of
18 Medicine shall remove any generic named drug product from the
19 formulary established by s. 465.025(6), Florida Statutes, if
20 every commercially marketed equivalent of that drug product is
21 "A" rated as therapuetically equivalent to a reference listed
22 drug or is a reference listed drug as referred to in "Approved
23 Drug Products with Therapuetic Equivalence Evaluations"
24 (Orange Book) published by the United States Food and Drug
25 Administration.
26 Section 2. Nothing in this act shall alter or amend s.
27 465.025, Florida Statutes, as to existing law providing for
28 the authority of physicians to prohibit generic drug
29 substitution by writing "medically necessary" on the
30 prescription.
31 Section 3. This bill shall take effect upon becoming a
