11  Senator Dyer moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 16, between lines 3 and 4,
15  
16  insert:  
17         Section 11.  The Secretary of the Department of Lottery
18  shall submit to the State Board of Administration, the Florida
19  Senate, and the Florida House of Representatives, a report on
20  the assessment of liquidated damages on the contract between
21  the department and the on-line vendor. Such proposal shall
22  include an analysis of any delays in the installation and
23  operation of the on-line system and any periods when the
24  on-line system was either inoperable or operating below
25  performance. The report shall also include an estimate of
26  liquidated damages based on the contract and the total sum of
27  funds available for deposit in the Education Enhancement Trust
28  Fund. The secretary shall not enter into any final agreement
29  on the assessment of liquidated damages until such time as the
30  report is submitted.
