  1                      A bill to be entitled

  2         An act relating to the City of Jacksonville;

  3         extending the operation of chapters 89-439 and

  4         91-362, Laws of Florida, relating to the

  5         Council of the City of Jacksonville and the

  6         City of Jacksonville Environmental Protection

  7         Board, notwithstanding the board's scheduled

  8         expiration on October 1, 2001; providing for

  9         the use of procedures under chapter 120,

10         Florida Statutes, including the hiring of

11         administrative law judges, for proceedings

12         involving air or water pollution in which the

13         board seeks to impose a penalty; providing an

14         effective date.

16  Be It Enacted by the Legislature of the State of Florida:

18         Section 1.  (a)  Notwithstanding the provisions of

19  section 2 of chapter 89-439, Laws of Florida, and section 1 of

20  chapter 91-362, Laws of Florida, sections 1 and 3 of chapter

21  89-439, Laws of Florida, shall not terminate and be of no

22  further force and effect on October 1, 2001, as scheduled by

23  such acts, but sections 1 and 3 of chapter 89-439, Laws of

24  Florida, as amended by section 2 of chapter 91-362, Laws of

25  Florida, shall continue to exist and operate.

26         (b)  In all proceedings involving air or water

27  pollution in which the City of Jacksonville Environmental

28  Protection Board seeks to impose a penalty, it shall, at the

29  option of the citizen, follow the procedures described in

30  sections 120.569 and 120.57, Florida Statutes, including, when

31  appropriately requested, the hiring of administrative law

  1  judges within the Division of Administrative Hearings to

  2  preside over disputed cases.

  3         Section 2.  This act shall take effect October 1, 2001.
