  1                      A bill to be entitled

  2         An act relating to terrorism; creating s.

  3         775.30, F.S.; defining the term "terrorism";

  4         providing for the payment of restitution of

  5         costs or damages with respect to any person who

  6         commits a prank or hoax act of terrorism;

  7         providing an effective date.

  8

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 775.30, Florida Statutes, is

12  created to read:

13         775.30  Terrorism defined; additional penalty for prank

14  or hoax act of terrorism.--

15         (1)  As used in the criminal code of this state, the

16  term "terrorism" means an activity that:

17         (a)1.  Involves a violent act or an act dangerous to

18  human life which is a violation of the criminal laws of this

19  state or of the United States; or

20         2.  Involves a violation of s. 815.06; and

21         (b)  Is intended to:

22         1.  Intimidate, injure, or coerce a civilian

23  population;

24         2.  Influence the policy of a government by

25  intimidation or coercion; or

26         3.  Affect the conduct of government through

27  destruction of property, assassination, murder, kidnapping, or

28  aircraft piracy.

29         (2)  In addition to any other penalty provided by law

30  with respect to any person who is responsible for a prank or

31  hoax act of terrorism which results in the mobilization or

  1  action of any law enforcement officer or any state or local

  2  agency, a person convicted of a prank or hoax act of terrorism

  3  shall be required by the court to pay restitution for all of

  4  the costs and damages arising from the prank or hoax act of

  5  terrorism.

  6         Section 2.  This act shall take effect July 1, 2002.
