  2         An act relating to local governments in a state

  3         of financial emergency; ratifying actions taken

  4         by local governments pursuant to s. 218.503,

  5         F.S., 1999, before its amendment by Senate Bill

  6         54-B; providing an effective date.

  7

  8         WHEREAS, the Legislature sought by passage of section

  9  132, chapter 99-251, Laws of Florida, which created section

10  218.503(5), Florida Statutes, to enact a general law

11  authorizing municipalities to impose parking surcharges under

12  certain circumstances and to specify the purposes for which

13  those surcharges may be expended, and

14         WHEREAS, the Legislature passed Senate Bill 54-B in its

15  2001 Special Session "B" to amend section 218.503(5), Florida

16  Statutes, to create a general law authorizing municipalities

17  in a state of emergency to impose a surcharge on the gross

18  revenues of certain parking facilities but did not clarify

19  that the Legislature intended to ratify the use of proceeds

20  collected and expended pursuant to this section before the

21  effective date of the amendment, NOW, THEREFORE,

22

23  Be It Enacted by the Legislature of the State of Florida:

24

25         Section 1.  Any ordinance of any municipality imposing

26  a surcharge pursuant to section 132, chapter 99-251, Laws of

27  Florida, is hereby ratified. All acts and proceedings,

28  including enforcement procedures, taken in connection with a

29  parking surcharge imposed by a municipality pursuant to

30  section 132, chapter 99-251, Laws of Florida, are ratified,

31  validated, and confirmed, and the surcharge is declared to be

  1  legal and valid in all respects from the date of enactment of

  2  chapter 99-251, Laws of Florida.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
