13         Amendment to Amendment (613005) (with title amendment) 

14         On page 1, between lines 16 and 17,

16  insert:

17         Section 1.  Section 765.539, Florida Statutes, is

18  created to read:

19         765.539  Organizations engaged in the practice of

20  cadaveric organ and tissue procurement or processing; pooling

21  of cells or tissues prohibited; exception.--Organizations

22  engaged in the practice of cadaveric or surgical organ and

23  tissue procurement or processing in this state are prohibited

24  from allowing human tissues from two or more donors to be

25  pooled during retrieval, processing, preservation, or storage

26  unless such tissue is sterile and free of all infectious

27  agents.  This includes unconventional infectious agents, such

28  as prions, which cause transmissible spongiform

29  encephalopathy.  For purposes of this section, "pooled" means

30  placed in physical contact or processed in any way which

31  allows any fluids or tissues to be commingled in any way
