1 House Joint Resolution
2 A joint resolution proposing an amendment to
3 Section 4 of Article VI of the State
4 Constitution relating to term limits.

6 Be It Resolved by the Legislature of the State of Florida:

8 That the amendment to Section 4 of Article VI of the
9 State Constitution set forth below is agreed to and shall be
10 submitted to the electors of Florida for approval or rejection
11 at the general election to be held in November 2002:
12 SECTION 4. Disqualifications.--
13 (a) No person convicted of a felony, or adjudicated in
14 this or any other state to be mentally incompetent, shall be
15 qualified to vote or hold office until restoration of civil
16 rights or removal of disability.
17 (b) No person may appear on the ballot for re-election
18 to any of the following offices:
19 (1) Florida representative,
20 (2) Florida senator,
21 (3) Florida Lieutenant governor, or
22 (4) any office of the Florida cabinet,
23 (5) U.S. Representative from Florida, or
24 (6) U.S. Senator from Florida

26 if, by the end of the current term of office, the person will
27 have served (or, but for resignation, would have served) in
28 that office for twelve eight consecutive years.
29 BE IT FURTHER RESOLVED that in accordance with the
30 requirements of section 101.161, Florida Statutes, the title

1 and substance of the amendment proposed herein shall appear on
2 the ballot as follows:
3 TERM LIMITS
4 Increases, from 8 to 12, the number of consecutive
5 years a state legislator, the Lieutenant Governor, or any
6 Cabinet officer may serve in that office before being denied
7 the right to have his or her name appear on the ballot for
8 re-election to that office. Removes provisions that apply
9 term limits by means of ballot access to members of Congress,
10 which the United States Supreme Court has determined violate
11 the Federal Constitution.
