13         Amendment to Amendment (703277) (with title amendment) 

14         On page 22, between lines 21 and 22,

16  insert:

17         Section 13.  Subsection (1) of section 553.512, Florida

18  Statutes, is amended to read:

19         553.512  Modifications and waivers; advisory council.--

20         (1)  The Florida Building Commission shall provide by

21  regulation criteria for granting individual modifications of,

22  or exceptions from, the literal requirements of this part upon

23  a determination of unnecessary, unreasonable, or extreme

24  hardship, provided such waivers shall not violate federal

25  accessibility laws and regulations and shall be reviewed by

26  the Accessibility Advisory Council. Notwithstanding any other

27  provision of this subsection, if an applicant for a waiver

28  demonstrates economic hardship in accordance with 28 C.F.R.

29  36.403(f)(1), a waiver shall be granted. The commission may

30  not consider waiving any of the requirements of s. 553.5041

31  unless the applicant first demonstrates that she or he has

  1  applied for and been denied waiver or variance from all local

  2  government zoning, subdivision regulations, or other

  3  ordinances that prevent compliance therewith. Further, the

  4  commission may not waive the requirement of s. 553.5041(5)(a)

  5  and (c)1. governing the minimum width of accessible routes and

  6  minimum width of accessible parking spaces.

11         On page 42, line 6, of the amendment, after the

12  semicolon,

14  insert:

15         amending s. 553.512, F.S.; requiring the

16         granting of a waiver of certain requirements

17         for accessibility purposes under certain

18         circumstances;
