18         648.275  Bond agency; ownership requirements.--

19         (1)  A person may not own, control, or otherwise have a

20  pecuniary interest in a bail bond agency unless such

21  individual is a licensed and appointed bail bond agent. Any

22  agency that is not in compliance with this subsection shall be

23  subject to the issuance of an immediate final order of

24  suspension of all operations until the agency achieves

25  compliance.

26         (2)  If the owner of a bail bond agency dies or becomes

27  mentally incapacitated, a personal representative or legal

28  guardian may be issued a temporary permit to manage the

29  affairs of the bail bond agency. Such person must appoint or

30  maintain the appointment of a primary bail bond agent, as

31  provided in s. 648.387, and may not engage in any activities

  1  as a licensed bail bond agent but must comply with s. 648.387

  2  during the administration of the estate or guardianship. A

  3  temporary permit is valid for a maximum of 24 months.

  4         (3)  Application for a temporary permit must be made by

  5  the personal representative or legal guardian upon statements

  6  and affidavits filed with the department on forms prescribed

  7  and furnished by the department. The applicant must meet the

  8  qualifications for licensure as a bail bond agent, except for

  9  the residency, examination, education, and experience

10  requirements.
