17 and insert: deficiency reserves. If a health maintenance
18 organization, through a health care contract, transfers to any
19 entity the obligation to pay any provider for any claim
20 arising from services provided to or for the benefit of any
21 subscriber, the liabilities of the health maintenance
22 organization under this section shall include the amount of
23 those losses and claims to the extent that the provider has
24 not received payment. No liability need be established if the
25 entity has provided to the health maintenance organization a
26 financial instrument acceptable to the department securing the
27 obligations under the contract, or the health maintenance
28 organization has in place an escrow or withhold agreement
29 approved by the department which assures full payment of those
30 claims. For purposes of this paragraph, the word "entity"
31 does not include this state, the United States, or an agency
