  1                      A bill to be entitled

  2         An act relating to governmental reorganization;

  3         creating the Law Enforcement Agency

  4         Consolidation Study Commission within the

  5         Executive Office of the Governor; providing for

  6         the membership of the commission; requiring the

  7         commission to study the effects of

  8         consolidating the law enforcement agencies in

  9         this state under a unified command; requiring

10         an initial report to the Governor and

11         Legislature; providing that commission members

12         are entitled to reimbursement for per diem and

13         travel expenses; requiring the commission to

14         submit a final report to the Legislature;

15         specifying requirements for the final report;

16         requiring the commission to recommend

17         consolidating and restructuring various

18         departments and agencies that employ law

19         enforcement personnel; abolishing the

20         commission on a specified date; providing an

21         effective date.

23  Be It Enacted by the Legislature of the State of Florida:

24

25         Section 1.  Law Enforcement Agency Consolidation Study

26  Commission.--

27         (1)(a)  There is created within the Executive Office of

28  the Governor the Law Enforcement Agency Consolidation Study

29  Commission. The commission shall be composed of:

  1         1.  Two representatives from private corporate industry

  2  who have expertise in corporate mergers, appointed by the

  3  Governor;

  4         2.  The Attorney General or his or her designee;

  5         3.  A member of the Senate, appointed by the President

  6  of the Senate; and

  7         4.  A member of the House of Representatives, appointed

  8  by the Speaker of the House of Representatives.

  9         (b)  The Executive Office of the Governor shall provide

10  staff support for the commission. The commission shall select

11  a chairperson from among its members.

12         (2)(a)  The commission shall meet for the purpose of

13  studying the effects of consolidating the law enforcement

14  agencies in this state under a unified command. The commission

15  shall submit an initial report of its findings and

16  recommendations to the Governor, the President of the Senate,

17  and the Speaker of the House of Representatives by March 1,

18  2003. The commission may file additional reports or

19  recommendations as are necessary in carrying out its duties.

20         (b)  Members of the commission shall not receive

21  compensation other than the salaries received in the course of

22  their employment, but the members are entitled to

23  reimbursement for per diem and travel expenses in accordance

24  with section 112.061, Florida Statutes.

25         (3)  The commission shall:

26         (a)  Require each state department, division, or agency

27  to submit a report to the commission on the number of

28  positions within that department, division, or agency which

29  are positions for sworn law enforcement personnel and identify

30  any section of the Florida Statutes upon which the department,

31  division, or agency relies for authority to employ the sworn

  1  law enforcement personnel. The report must be submitted to the

  2  commission by October 1, 2002.

  3         (b)  Prepare and submit a report to the Legislature

  4  before the 2003 Regular Session which includes recommendations

  5  for:

  6         1.  Proposed legislation to revise the Florida Statutes

  7  to reflect the consolidation of all positions for sworn law

  8  enforcement personnel within the Department of Law

  9  Enforcement. The commission may consult with any state agency

10  in preparing proposed legislation and may direct the Division

11  of Statutory Revision of the Office of Legislative Services to

12  assist the commission in identifying relevant sections of the

13  Florida Statutes.

14         2.  Changes within any affected department, division,

15  or agency to reduce administrators and management personnel

16  and save expenses as a result of consolidation.

17         3.  Repeals of Florida Statutes to reflect any

18  consolidation of positions for sworn law enforcement

19  personnel.

20         4.  Changes within the Department of Law Enforcement to

21  reflect the proposed consolidation. Any recommendation may

22  include the creation of new divisions or the restructuring of

23  divisions within the department and any recommended

24  legislation.

25         (4)  In addition to any other affected department,

26  division, or agency, the commission shall make recommendations

27  for consolidating and restructuring the Department of

28  Agriculture and Consumer Services, the Department of

29  Environmental Protection, the Division of Alcoholic Beverages

30  and Tobacco within the Department of Business and Professional

31  Regulation, the Department of Highway Safety and Motor

  1  Vehicles, the Division of Insurance Fraud within the

  2  Department of Insurance, the Florida Capitol Police within the

  3  Department of Management Services, the Office of Motor Carrier

  4  Compliance within the Department of Transportation, the Bureau

  5  of Fire Investigation within the Division of State Fire

  6  Marshal of the Department of Insurance, the Fish and Wildlife

  7  Conservation Commission, the Florida Agricultural and

  8  Mechanical University Police, the Florida Atlantic University

  9  Police Department, the Florida Gulf Coast University Campus

10  Police and Safety, the Florida International University Public

11  Safety Department, the University Police Department of Florida

12  State University, the Pensacola Junior College Police

13  Department, the Santa Fe Community College Police Department,

14  the University of Central Florida University Police

15  Department, the University of Florida University Police

16  Department, the University of North Florida University Police

17  Department, the University of South Florida Campus Police

18  Department, the University of West Florida Police Department,

19  the Division of Blind Services within the Department of

20  Education, the parks police of the Division of Recreation and

21  Parks within the Department of Environmental Protection, and

22  all medical officers within the Agency for Health Care

23  Administration who are sworn law enforcement officers.

24         (5)  The commission is abolished July 1, 2003.

25         Section 2.  This act shall take effect upon becoming a

26  law.
