  1                      A bill to be entitled

  2         An act relating to prescription drug claim

  3         identification cards; creating s. 627.4302,

  4         F.S.; providing intent; requiring certain

  5         entities to provide a benefits identification

  6         card by a date certain for specified purposes

  7         under certain circumstances; providing an

  8         exception; specifying required information;

  9         providing for temporary stickers for annual

10         renewal cards; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Section 627.4302, Florida Statutes, is

15  created to read:

16         627.4302  Identification cards for processing

17  prescription drug claims.--

18         (1)  The purpose of this section is to improve patient

19  care by minimizing confusion, eliminating unnecessary work,

20  decreasing patient wait time, and improving business

21  efficiencies.

22         (2)  Any health insurer or health maintenance

23  organization and all state and local government entities

24  entering into an agreement to provide coverage for

25  prescription drugs on an outpatient basis shall provide a

26  benefits-identification card containing the following

27  information:

28         (a)  The name of the claim processor.

29         (b)  The issuer identification number, also referred to

30  as the Banking Identification Number or "BIN," assigned by the

31  American National Standards Institute, unless instruction is

  1  provided on the card for ready access to such number by

  2  electronic means.

  3         (c)  The insured's prescription group number.

  4         (d)  The insured's identification number.

  5         (e)  The insured's name.

  6         (f)  The claims submission name and address.

  7         (g)  The help desk telephone number.

  8         (h)  Any other information that the entity finds will

  9  assist in the processing of the claim.

10         (3)  The benefits-identification card must present the

11  information in a manner readily identifiable or,

12  alternatively, the information may be embedded in the card and

13  available through magnetic stripe or smart card. The

14  information may also be provided through other electronic

15  technology.

16         (4)  Any entity providing a

17  health-benefits-identification card containing all of the

18  information required by this section shall not be required to

19  provide a separate identification card for prescription drug

20  benefits.

21         (5)  A benefits-identification card required under

22  subsection (2) shall be issued no later than 60 days after any

23  change in the information contained on the card becomes

24  effective. If an entity subject to this section issues annual

25  renewal cards, it may issue a temporary sticker containing the

26  new information in lieu of issuing a new card prior to the

27  annual renewal date.  Such sticker must be designed so that it

28  can be attached to the existing card.

29         Section 2.  This act shall take effect October 1, 2002,

30  and shall apply to policies or contracts issued or renewed on

31  or after that date.

  1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  2                         Senate Bill 1412

  4  The Committee Substitute provides the following changes:

  5  1.    Requires any health insurer, health maintenance
          organization and all state and local government
  6        entities, rather than any state funded or state mandated
          program, that provides outpatient prescription drug
  7        coverage to issue a prescription drug benefits
          identification card containing certain specified
  8        information; and

  9  2.    Provides that this act would take effect October 1,
          2002, and would apply to policies or contracts issued or
10        renewed on or after that date.
